Description
NZS3916 was issued in 2013 as an adaptation from NZS 3910:2013 (NZS3910) to deal with the situation where the Contractor is responsible for overall design as well as construction.
This course provides an overview of NZS3916 and how it may be used to greatest effect. It explains the key differences from its parent standard contract NZS 3910, how risk is allocated, procurement considerations, and its effect on the ordinary roles and responsibilities of Engineer to Contract, Engineer’s Representative, Principal, Contractor and designers.

Learning outcomes
Participants will be able to:
- Explore the considerations in procuring construction contracts under NZS3916.
- Summarize the ‘Principal’s Requirements’.
- Identify the allocation of risk, liabilities and other key differences between NZS3916 and NZS3910.
- Recognise how the roles of the engineer are affected by NZS3916, and how they may be effectively performed.
- Explore novation and other considerations for designers.
Intended audience
Industry participants who are currently administering or using NZ3916 or who are considering entering NZS3916. It is relevant to clients and their advisers, those who act, engage or work with engineers and engineer’s Representatives, and to contractors, subcontractors, and other design consultants, project managers and quantity surveyors.
Format
This is offered as a 4-hour live online course. The course contains brief worked examples and opportunities for questions during and at the end of the course. Course material, which will be sent out to participants ahead and includes a copy of slides and supplementary material. Participants are encouraged to have a copy of NZS3916 with them, although this is not necessary.
The course will have a short break hourly, and a 30-minute lunch break.
Presenter information
Peter Degerholm is a registered quantity surveyor, arbitrator, mediator and adjudicator in construction disputes and is an authority on the Construction Contracts Act 2002. He was a member of the Standards New Zealand review committees for NZS3910 and the related 3915, 3916 and 3917 standards.
