What's new in construction law
The past few years have seen a number of changes to our Construction Law. The Construction Contracts Act and Building Act have been amended, a new version of NZS3910 has been produced, and there have been a number of important court cases. This one day course brings delegates up to date with recent developments.
Description
Participants in this course should gain an understanding of:
- Changes to the Building Act requiring written contracts fo residential projects
- The amendments to the Construction Contracts Act 2002, with a particular focus on:
- Extension of the Act to cover engineers
- Dealing with retention money
- The new NZS3910 including the new NZS3917
- Recent case law from New Zealand and abroad including cases on:
- ‘Clawbacks’ and how these impact on contractors and subcontractors.
- Deleting contract clauses and creating ambiguity
- Calling in performance bonds.
- Liquidated damages and ‘penalties’
- Recent developments in contract drafting such as the inclusion of clauses limiting the contractor’s financial liability
This workshop is practical, hands on and interactive. Case studies and every-day examples are used throughout.
Delegates who have attended this workshop will gain practical understanding of the legal issues that impact on contract management.
Presenter information
Gigi Fenster studied law in South Africa, where she was a founder member of the Construction Industry Development Board, a lecturer on the Association of Arbitrator’s Construction Law course, and a provider of training to the construction industry. For the past ten years she has lived in New Zealand, and has worked in government and in the polytechnic sector teaching (building) law. Gigi has taught law for more than twenty years and has written training courses, manuals and seminar notes for the construction and other industries. She provides ongoing consulting services to private firms and government. Gigi has a particular interest in international engineering contracts and the FIDIC contracts in particular. She has provided training on FIDIC in various countries in Africa, Asia and the Pacific.
