Description
The Engineer to the Contract is a key role in any construction contract, often overseeing various tasks including supervising the contractor, certifying work, receiving payment claims and representing the client on-site.
This one-day workshop will assist you in fulfilling your role effectively and successfully in accordance with the law.
After attending this workshop you will gain an understanding of:
- Whether the Engineer is supposed to be independent and impartial or to act as the agent of their client
- What exactly Variations and Extensions of Time are and how we value them
- What the potential liability is when supervising and certifying work, including the answers to questions like:
- Can the Contractor sue you if they think you have under-certified work?
- Can your client sue you if they think the work you approved is defective?
- The Construction Contracts Act and your role in dealing with payment claims under the Act
- What can happen if someone disagrees with a decision you make.
Presenter Information
Gigi Fenster
Dr Fenster studied law in South Africa. She has spent most of her career working in the construction industry, training and advising on construction law matters. She is a published author, and her novel The Intentions Book was a finalist in the New Zealand Post Book Awards. In 2016 she was awarded a PhD in Creative Writing from Victoria University.
